Learning Design Community Terms and Conditions

By uploading or otherwise submitting any content to the Community, you acknowledge and agree to be bound by the terms and conditions set out herein, and the applicable Creative Commons license associated with each piece of content. If you do not agree to these terms, do not use the platform.
1. Scope.
These terms and conditions apply to your use of the FeedbackFruits Learning Design Community, which serves as a collaborative hub where educators share best-in-class learning designs, templates, and pedagogical content. Our purpose is to democratize access to proven, high-quality teaching and learning practices, enabling institutions worldwide to scale impactful education and continually enhance student outcomes.
“Community” refers to the online platform (https://feedbackfruits.com/learning-design-community-ldc) operated by FeedbackFruits,including its features, functionality, and any associated services, through which users may upload, share, access, and make use of Learning Designs contributed by themselves or others. This includes all content made available on the platform, and is intended to foster creative exchange and collaboration among users.
2. Intellectual Property License.
2.1 You hereby grant to the public a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable license to use, reproduce, display, distribute, adapt, and otherwise exploit your content under the Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0) license (“License”). This license allows others to use, remix, and share your content, even commercially, as long as they credit you and license new creations under the same terms. Please be referred to our FAQ.
2.2 You represent and warrant that:
2.2.1 You have the legal right and authority to license the content under the selected License;
2.2.2. The content does not infringe upon any third-party rights, including copyright, trademark, or privacy rights;
2.2.3 The license you select is accurate and properly reflects your intent to share the content on the Community.
2.3 Your license is:
2.3.1 Irrevocable once applied,
2.3.2 Binding on all subsequent users of your content, and
2.3.3 Displayed for others to view and comply with.
2.4 FeedbackFruits disclaims any responsibility for misuse of your content by third parties who fail to adhere to the applicable license. You agree that your use of the Community, and the licensing of your content, is at your own risk and subject to the terms of the License.
2.5 FeedbackFruits will make commercially reasonable efforts to display your selected license alongside your content and store it in content metadata. You agree to indemnify and hold harmless FeedbackFruits from any claims arising from your content, your licensing choices, or any breach of your warranties.
3. Restrictions.
As a creator of Learning Designs, you are prohibited from:
3.1. Publishing inappropriate content, including but not limited to sexually explicit content, hate speech or offensive language, graphic violence, threats of any kind, illegal activities, unauthorised third party intellectual property;
3.2. Circumvent or bypass any technological protection measures relating to the Community;
3.3. Disassemble, decompile, decrypt, hack, emulate, exploit, or reverse engineer any software or other aspect of the Community;
3.4. Publish, copy, rent, lease, sell, export, import, distribute, or lend the Community; or
3.5. Enable access to the Community by unauthorised users or third party applications.In case of any breach of these terms, FeedbackFruits reserves the right to permanently remove any uploaded content, deny access to the Community, or, in accordance with applicable law, take any further action as it considers, in its sole discretion, appropriate.
4. No warranties.
FeedbackFruits makes no warranties, either express or implied, with respect to the use of the Community, and you understand that the use of the Community is at your own risk. FeedbackFruits does not guarantee the accuracy of the information available on the Community. The Community is available on an “as is” basis, and to the extent permitted under your local law, we exclude any implied warranties, including for merchantability, fitness for specific purposes or satisfactory quality. We do not guarantee fault-free, uninterrupted, timely, secure or error free Community.
5. Limitation of liability.
If FeedbackFruits breaches these terms, or if you have any basis for recovering damages despite the limitations included in these terms, you agree that your exclusive remedy is to recover from FeedbackFruits or any affiliates, suppliers, resellers, distributors, and vendors, direct damages up to a total of EUR 100, even if this remedy does not fully compensate for any losses or if we knew or should have known about the possibility of damages. To the extent permitted by applicable law and regardless of the legal basis of the claim, you cannot recover any other damages, including without limitation, consequential, lost profits, special, direct, incidental, or punitive damages.
6. Applicable Law.
These terms are governed by Dutch law, and any disputes arising from these terms will be brought to the competent court in Amsterdam.
7. Changes.
FeedbackFruits may change these terms at any time and by continuing the use of the Community after the changes become effective, you agree to the new terms.
8. Takedown Policy.
If you would like to take down any content, or if you believe that any content on the Community infringes your copyright or other intellectual property rights, please notify us at support@feedbackfruits.com. Your notice should include the following information:
8.1 Your name and contact information.
8.2 A description of the applicable copyrighted work.
8.3 The URL(s) or other location(s) of the content.
8.4 In case of any alleged copyright or other intellectual property rights infringement, please include the following additional information:
8.4.1 A statement that you believe, in good faith, that the use of the content is unauthorized.
8.4.2 A statement, under penalty of perjury, that the information you’ve provided is accurate and that you are authorized to act on behalf of the copyright owner.
8.4.3 FeedbackFruits will review your notice and take appropriate action in accordance with applicable law.
FAQ for Contributors to the Learning Design Community
Please read this FAQ for users of Learning Design Community using CC BY-SA.
1. What is "CC BY-SA"?
CC BY-SA is a type of copyright license. It means:
- You let other people use, share, edit, and remix your work, even for commercial purposes.
- They must credit you as the original creator.
- If they change your work, they must share it under the same license.
2. Am I giving up my rights?
No. You still own your content. You are simply giving permission for others to use it under certain conditions.
3. What can others do with my content?
Others can:
- Download and use it
- Modify it
BUT only if they:
- Credit you properly
- Use the same license (CC BY-SA) for any derivative work they create from your work
4. What does “credit me” mean?
People using your work must say something like:
“Based on a design by [Your Name], licensed under CC BY-SA 4.0, Link:”
We’ll help them by showing your name and the license info next to your upload.If you add a title or description, we’ll include that too.
5. I’m using someone else’s content on the platform. What do I have to do?
You must:
1. Credit the original creator (we help you with that).
2. Say if you changed it.
3. Share your new content under the same license (CC BY-SA).
6. Can I profit from something I create using someone else’s work?
Yes, you can use CC BY-SA content in commercial work. Just credit the original creator and share your version under the same license.
7. Can someone else profit from something they created using my work?
Yes, but they must credit you and share their version under CC BY-SA too.
8. Can I change the license on my upload later?
No, once you publish content under CC BY-SA, it is permanent.
9. What if I don’t want others to change or use my work?
Then, don’t upload it here. The Learning Designs Community is designed to encourage sharing and collaboration. Only upload content that you are okay with others using under the CC BY-SA rules.
10. Can I remove my content after sharing it under
CC BY-SA 4.0? What happens to the license if I do?
Yes, you can remove or delete your content. However, removing your content does not revoke or cancel the Creative Commons license you already granted. Anyone who received your work under the CC BY-SA 4.0 license before removal can continue to use, share, and adapt it according to the license terms, as those rights are permanent and cannot be undone.
